What Colonia Del Norte Unit One Homeowners Association's governing documents say
Colonia Del Norte Unit One is a standard single-family homeowner association (HOA) in Arizona. This document is the Association's Bylaws, which govern the internal operations of the HOA—meetings, board of directors, and committees. It does not contain the full set of community rules (CC&Rs), and many specific restrictions (e.g., pet limits, rental rules) are not included here.
- Governance & Board structure: The Board of Directors manages the association; originally 7 directors not required to be members, but amendments now require directors to be members in good standing and reside in the complex. Board size may be between 4 and 8 directors (as of 2009 amendment). Directors serve 2-year terms with a maximum of two consecutive terms (per 2013 amendment). Officers (president, vice-president, secretary, treasurer) are elected annually by the Board.
- Meetings of Members: Annual meetings are held on the second Tuesday of May (per 2013 amendment reverting from January). Special meetings may be called by the President, the Board, or upon written request of members holding 1/4 of Class A votes. Written notice must be mailed at least 15 days before a meeting. Quorum at a regular meeting is a majority of votes of each membership class; if no quorum, an adjourned meeting may proceed with only 1/10 of the votes.
- Assessments & Enforcement: The Board may suspend voting rights and use of recreational facilities for any member in default of assessments or in violation of recorded restrictions. The Board may foreclose the lien against a property for assessments unpaid 30 days after due date, or bring a personal action against the owner.
- Architectural Control Committee: The Association must appoint an Architectural Control Committee, as provided in the Declaration. Its specific rules and approval process are not detailed in these Bylaws.
- What this document doesn't cover: These Bylaws do not contain pet restrictions, leasing rules, parking guidelines, age restrictions, or fee amounts. Those rules are likely in the Declaration of Covenants, Conditions and Restrictions (CC&Rs), which is referenced but not included here.
