This is a Third Amendment to the Declaration of Covenants, Conditions and Restrictions for Turtlewood at Southport, a 50-lot single-family subdivision in Southport, NC. It adds stormwater permit compliance rules that bind all lot owners. The original declaration and prior amendments are not included here.
- Stormwater permit compliance: All lots must comply with State Stormwater Management Permit SW8 041002. The maximum built-upon area per lot varies: Lots 1, 3-10, 24-26, 29-31, 33: 7,600 sq ft; Lots 2, 11, 21-23, 27-28, 32, 34-40, 48-50: 8,200 sq ft; Lots 12-20, 41-47: 8,575 sq ft. Built-upon area includes structures, asphalt, concrete, gravel, brick, stone, slate, and coquina, but excludes raised open wood decking and pool water surface.
- Vegetated buffers & drainage: Each lot must maintain a 50-foot wide vegetated buffer between all impervious areas and surface waters. All roof drains must terminate at least 50 feet from the mean high water mark of surface waters. Filling or piping of vegetative conveyances (ditches, swales) is prohibited except for average driveway crossings.
- Alteration restrictions: Alteration of drainage as shown on the approved permit plan is not allowed without concurrence from the Division of Energy, Mineral and Land Resources. The stormwater covenants cannot be altered or rescinded without express written consent of the State of North Carolina.
- What this document doesn't cover: This amendment only adds stormwater rules. It does not cover other typical HOA topics such as architectural review, leasing restrictions, pet limits, parking, or assessments. Those may be in the original Declaration or other amendments not provided here.
