This is an amendment to the Declaration of Covenants, Conditions, and Restrictions for the Mariners Pointe Community (formerly Flagship Point at Long Beach Point) in St. James, NC. It establishes a homeowners association (Mariners Pointe Community Association, Inc.) that governs single-family lots. The rules apply to all lot owners, residents, and their tenants.
- What you own & maintain: You own your lot and dwelling. The Association maintains the common areas (including private roads, stormwater systems, and drainage easements). You must maintain your lot and dwelling in good condition, keep lawns cut (grass no taller than 6 inches), and not allow rubbish or unsightly storage.
- Architectural review: All exterior improvements (including fences, sheds, landscaping changes, tree removal, and color changes) require prior written approval from the Architectural Review Committee (ARC) or Association. Plans are deemed approved if not acted on within 60 days of submission.
- Leasing & rentals: Leases must be for at least 6 months, in writing, and include a clause binding the tenant to the Declaration and Association rules. Owners must provide copies of leases to the Association.
- Pets: Reasonable numbers of cats, dogs, and household pets are allowed but must be kept inside, not bred commercially, and not become a nuisance. Pets must be leashed outside, and owners must clean up droppings. The Association can expel animals for continuing violations.
- Parking & vehicles: Each lot must provide off-street parking for at least 2 cars. No commercial trucks, RVs, campers, trailers, or boats may be kept on lots (present over 10 hours or overnight). Inoperable vehicles must be garaged. Parking on lawns is prohibited.
- Signs & flags: One 'For Sale' or 'For Rent' sign (max 36"x24") and political signs (max 24"x24", displayed 45 days before to 7 days after an election) are allowed. U.S. and North Carolina flags (max 4'x6') may be flown on house-mounted flagpoles approved by the ARC. No other signs or flags are permitted without Association approval.
- Use restrictions: No business or commercial activity is allowed on lots (except sales by owners, Declarant, or builders). No above-ground pools, exterior antennas (except those protected by FCC rules), or clothes hanging devices are permitted. Window coverings visible from outside must be white or neutral. Exterior lights must be clear or white. Seasonal decorations must be removed promptly after the holiday.
- Stormwater & environmental restrictions: Maximum built-upon area per lot is 2,935 square feet (for Lots 73-86). A 30-foot vegetated buffer must be maintained from mean high water. Filling or altering drainage swales is prohibited. Swimming in retention areas is banned; docks require Association approval.
