It grants the current owner permission to install a shake-style roof that violates the community's design guidelines, but only until the roof needs replacement. The variance runs with the property and binds all future owners.
- Roof variance terms: The shake-style roof is allowed only until it needs replacement. When replacement is required, the then-owner must replace the entire roof with materials and colors that comply with the Lantana Design Guidelines, after obtaining prior written approval from the Architectural Review Committee (ARC).
- Resale disclosure: As long as the shake roof remains, any resale certificate issued for the property must note the roof as an existing violation of the Declaration and Design Guidelines.
- Enforcement & penalties: If an owner replaces the roof without following the variance terms, the Association may record a Notice of Property Being in Violation and impose fines until the roof is brought into compliance.
- Binding on future owners: The variance runs with the title to the property and binds all current and future owners, heirs, and assigns until it is formally withdrawn by the Association.
