It is NOT a full homeowners' association rulebook; it is a builder-imposed covenant that runs with the land and primarily governs dispute resolution, warranty limitations, and mold liability between the original owner and builder (Bloomfield Homes). Buyers and current owners should understand that this document adds binding arbitration requirements and waives certain implied warranties.
- Dispute resolution (mandatory arbitration): Any dispute between the owner and builder—including contract, warranty, tort, or statutory claims—must first go to mediation, then to binding arbitration under the Federal Arbitration Act, not to court. The owner initially pays no more than the cost of filing a lawsuit. The arbitrator can award costs, fees, and attorney's fees to the prevailing party.
- Warranty and waiver of implied warranties: The only express warranty from the builder is the written Limited Home Warranty. By signing, the owner waives any implied warranty of good and workmanlike construction to the fullest extent allowed by Texas law. The owner must deliver the Limited Warranty to any future purchaser.
- Mold and biological impurities – liability waiver: The owner assumes all responsibility for mold prevention and maintenance. The builder disclaims any liability for damages, personal injury, or health effects from mold, chemicals, or biological impurities. The owner releases the builder from all such claims and agrees to obtain waivers of subrogation from their own insurer.
- Builder's repurchase right: If the reasonable cost to repair a construction defect exceeds 20% of the improvements' fair market value, the builder may elect to repurchase the property under Texas Property Code Section 27.004. This right survives the deed transfer and binds future owners.
- What this document doesn't cover: This document does not contain typical community rules such as pet limits, leasing restrictions, parking rules, architectural guidelines, or any homeowner association structure. Those rules, if any exist, would be in a separate set of covenants or HOA documents for the Plantation subdivision.
