What Pearl Addition's governing documents say
Pearl Addition is a single-family subdivision in Cleburne, TX, governed by restrictive covenants recorded in 1987 that run with the land. These covenants set minimum construction standards and prohibit certain uses but do not create a mandatory homeowners association or impose assessments.
- Minimum home size & construction materials: Any residence must have at least 1,250 square feet of floor space (excluding porches and garages) and be at least 80% brick, rock, or masonry; roofs must be wood shingle or comparable. Garages, barns, etc., need not be masonry.
- No business or commercial activity: No business or commercial activity is permitted on any lot unless unanimously approved by the Architectural Control Committee.
- Architectural Control Committee: A committee (initially three named individuals) must approve all construction plans, specifications, and location regarding quality, design, and harmony. If no decision in 30 days or no suit before completion, approval is deemed given.
- Setback & location restrictions: No building shall be closer to a road than the setback shown on the plat, nor less than 5 feet to a side line (original or subdivided). Exceptions require unanimous committee approval.
- Prohibited structures & uses: No trailer, mobile home, basement, tent, shack, barn, garage, or outbuilding may be used as a residence. No house may be moved into the addition. No junk yard, used car storage, or commercial animal raising is allowed.
- Animals & nuisance: No hogs or chickens; no animals raised for commercial purposes or that become a nuisance. Dogs not confined to the residence are considered a nuisance. No obnoxious or offensive activities; lots must be kept clear of trash.
- Term & extension: These covenants bind all owners for 35 years from 1987, then automatically extend for successive 10-year periods unless a majority of lot owners record a modification or release.
- What this document doesn't cover: This document does not create a homeowners association, impose fees or assessments, or regulate common areas. There are no rules about leasing, parking, or specific pet types beyond nuisance standards.
