This is an amendment to the HOA covenants for Villas of Colleyville, a single-family home community in Colleyville, TX. It updates the rules on leasing and ownership, so it's most relevant to homeowners who rent out their property or plan to buy as an investment. The amendment is part of the community's governing documents, which also include the original Declaration and earlier amendments.
- Leasing & rentals: Dwellings can only be leased in their entirety, not as individual rooms. Leases must be at least 12 months, and the owner must notify the board and get confirmation before signing. There's a cap: no more than 4 dwellings (out of the community) can be leased at any one time, on a first-come, first-served basis. New owners must wait 12 months after purchase before leasing, unless they get a hardship exception.
- Tenant screening & restrictions: Owners must run a background check on prospective adult tenants, including a criminal history check. Felons (for crimes like drug manufacture, theft, burglary, or crimes involving minors) and registered sex offenders (Level 2 or 3, or unassigned) are prohibited from leasing or residing in the community. Sex offenders also cannot own a home here.
- Owner occupancy requirement: The community aims to be predominantly owner-occupied. The leasing cap and the 12-month waiting period for new owners are designed to limit the number of rentals. Owners who lease must provide tenants with copies of the Declaration, Bylaws, and rules.
- Hardship exceptions: The board can allow leasing before the 12-month wait or beyond the cap in cases of job relocation, marital status change, health reasons, death of the owner, or temporary relocation with intent to return. These exceptions are granted for one year at a time and require board approval.
- Owner liability for tenant violations: The owner is responsible for all violations by tenants and their guests. Fines for tenant violations are assessed against the owner, and the association can evict tenants on the owner's behalf, with costs charged to the owner.
- Ownership limits: No individual, entity, or combination can own more than two lots or dwellings in the community. This applies to future acquisitions, not current ownership.
