Hogan Acres Addition is a single-family-home subdivision in Joshua, TX, governed by restrictive covenants that apply to all lot owners. These rules control home size, materials, setbacks, and uses to maintain a residential character.
- Minimum home size & construction materials: Any residence must have at least 1,500 square feet of floor space (excluding porches and garages) and be at least 80% brick, rock, or masonry. Other buildings (garages, barns) must be of good construction but do not require the same masonry percentage.
- Architectural review: No building may be erected, placed, or altered until plans and a location plan are approved by an Architectural Control Committee. The committee must approve or disapprove within 30 days of submission; otherwise, approval is deemed given unless a lawsuit is filed before completion.
- Use restrictions: No business or commercial activity is allowed unless unanimously approved by the committee and all abutting lot owners. No trailer, mobile home, basement, tent, shack, barn, garage, or outbuilding may be used as a residence. No house may be moved into the addition. No hogs may be kept, and no animals may be kept or raised for commercial purposes or as a nuisance.
- Setbacks: No building may be located nearer to a road than the building setback lines shown on the plat, nor within 15 feet of a side lot line (whether original or subdivided). Exceptions require unanimous approval of the Architectural Control Committee.
- Prohibited activities: No lot may be used as a junk yard or for selling/storing used cars. No oil drilling, mining, quarrying, or related operations are permitted. No nuisance or obnoxious/offensive activities are allowed; lots must be kept free of trash and debris.
- Duration & amendment: These covenants run with the land for 35 years from March 1, 1978, and automatically renew for successive 10-year periods unless a majority of lot owners record an instrument modifying or releasing them.
- Enforcement: Any lot owner or the original declarants may enforce these covenants by legal proceedings. Invalidation of one covenant does not affect the others.
- What this document doesn't cover: This document does not address annual assessments or HOA fees, pet limits beyond hogs and commercial animals, leasing or rental restrictions, parking rules, or fencing requirements.
