Elysium Estates is a single-family subdivision in Kaufman, TX, governed by a homeowners' association (HOA). You own your lot and house; the CC&Rs set rules for use, construction, and maintenance to maintain a uniform plan for the community.
- Property use & housing type: Lots are for one single-family residence only. No mobile homes, manufactured homes, or trailers. Site-built homes must be at least 2,000 square feet.
- Pets & animals: Up to 20 chickens and one rooster are allowed. Other animals (cattle, horses, goats, sheep) are limited to one head per three acres (cattle/horses) or three animal units per acre (other farm animals), with no overgrazing. Livestock must be contained.
- Vehicles & parking: No more than one non-working vehicle allowed on the property at any time. Business/commercial activity and storage of inoperable vehicles are prohibited. Each residence must have a two-car garage.
- Temporary structures & RVs: No temporary residences or RVs as permanent living quarters. An RV may be used only during initial home construction, for up to 90 days, with approval.
- Construction & maintenance standards: All residences must have siding of wood, metal, or Masonite. Window- or wall-type air conditioners are not allowed. Landscaping must be installed within 60 days of occupancy. Damaged homes must be repaired within 60 days or demolished/removed within 90 days.
- Outbuildings & structures: Any secondary structure (e.g., shop) must match the residence's facade and be located behind the front wall of the home, not visible from the street. Outbuildings must be new construction of same style/design as the residence.
- Architectural control & variances: Declarant (developer) has the right to grant variances and amend the declaration unilaterally without owner consent. The declaration runs with the land for its term.
