This is a supplemental amendment to the HOA covenants for Phase 1B.1 of Northspur, a residential subdivision in Kaufman County, TX. It adds specific requirements, notices, and easements for lots in this phase. Homeowners and buyers should note it supplements the main declaration, not replaces it.
- Minimum square footage: All dwellings must meet minimum living area (excluding porches, garages, non-A/C areas): 1,500 sq ft on 40' lots, 1,600 sq ft on 50' lots, and 2,000 sq ft on 70' lots.
- Notices & existing conditions: Owners acknowledge that Phase 1B.1 is near environmentally sensitive areas, wildlife habitats (including certain common areas), FEMA Zone AE flood zone, and various easements (e.g., 100-ft and 75-ft Atmos easements). Owners assume all risks from plants/wildlife and agree the Association has no duty to control or eradicate them.
- Indemnification & liability: Each owner must defend, indemnify, and hold harmless the Declarant, Association, management company, and affiliates from all claims arising from the conditions (including negligence). Owners acknowledge no representations about water levels, safety, or future changes.
- Community fences: Community fences have been or will be constructed on or adjacent to certain lots; the Declarant, Association, and fence owner have an easement on adjacent lots for access and maintenance per the Declaration.
