What Winding Creek Ranch's governing documents say
Winding Creek Ranch is a single-family residential subdivision in Kaufman County, Texas. The recorded Covenants and Restrictions apply to homeowners and govern land use, buildings, animals, vehicles, and fences. There is no homeowners' association or monthly fee mentioned; compliance is enforced through deed restrictions.
- What you own & maintain: Each tract is a separate lot for single-family use. Driveways must be installed and maintained by the owner. Septic tanks and water meters are required per dwelling.
- Animals & livestock: Cows are limited to one head per acre and must be kept in a sanitary, odorless condition. Chickens, guinea fowl, and similar fowl are allowed if housed at least 50 feet from side property lines and kept neatly. Exotic game animals are prohibited if they affect health, safety, or welfare of neighbors. All animals must be fenced appropriately, and animals cannot be kept without fencing.
- Fences & structures: Fences, hedges, and walls cannot exceed 6 feet in height measured from the ground. All fences must be approved in writing by the Architectural Control Committee; unapproved fences may be removed without notice. No tents, shacks, sheds, or temporary structures may be used as a residence without written ACC permission.
- Vehicles & parking: No motor vehicle may be parked, abandoned, or left on any tract or street for more than 5 days. Vehicles that are inoperable or lack current license plates are not permitted to remain on any tract. Repairing or restoring motor vehicles outside an enclosed building is prohibited without ACC approval.
- Building & dwellings: Only one single-family dwelling is allowed per tract unless the ACC grants written permission for additional residences. All residences must have a water meter and county-approved septic system. No building construction may begin until the final plat is filed and all new roads are built and approved. Off-site built homes are subject to the same restrictions.
- Architectural control: All structures, dwellings, or housing must receive prior written approval from the Architectural Control Committee (ACC). The ACC is composed of Kenneth Lane and B.E. Rutledge, with authority to designate successors. The ACC may grant automatic extensions if the residence is neat and property well-maintained; permission may be revoked at any time.
- Term & amendments: These restrictions are effective for 20 years from the recording date (January 13, 2014), after which they automatically renew for 5-year periods unless changed. The Declarant (LR Land Co LLC) has the right to unilaterally amend the restrictions for curing errors, ambiguities, or furthering the general plan, but such amendments must be consistent with the scheme.
- What this document doesn't cover: There are no rules about leasing, rentals, HOA fees, assessments, parking of boats/RVs, or specific architectural style. This is a partial set of restrictions; property owners should check for any subsequent amendments or supplemental documents.
