Jacob's Ranch is a standard single-family home HOA in Apache Junction, AZ. The Declaration of Covenants, Conditions and Restrictions (recorded 2005) applies to all property owners, residents, and lessees. It sets rules for home businesses, leasing, parking, pets, and requires architectural approval for any exterior changes.
- Architectural review: Any exterior construction, modification, or demolition requires prior approval from the Design Review Committee (DRC). The DRC has 45 days to act; if no decision is made, approval is deemed granted. The DRC may consider aesthetics and has sole discretion to disapprove even if plans comply with guidelines.
- Use restrictions & home businesses: All lots must be used for residential purposes only. Home businesses are allowed only if not detectable from outside (sight, sound, smell), involve no client visits, no non-resident employees, and no increased traffic. Leasing a home is not considered a business.
- Parking & vehicles: Vehicles must be parked in the garage first; driveway parking is secondary. No street parking is allowed if garage or driveway space is available. No inoperable vehicles, boats, RVs, or trailers may be visible from neighboring property. Garage doors must stay closed except when entering or exiting.
- Leasing & rentals: Leases must be in writing, for an initial term of at least one month, and cannot be for less than the entire lot and residence. Owners must provide the association with lease start/end dates, tenant names, and emergency contact info. The owner is liable for tenant violations.
- Pets: The board determines a reasonable number of dogs, cats, and household birds per lot. Dogs must be leashed (max 6 ft) when off the lot and cannot enter other lots. Owners must promptly remove pet waste from common areas. The board may restrict dogs from portions of common area and can order removal of dangerous or nuisance animals.
- Assessments & liens: The association levies regular assessments (equal per lot, based on budget) and special assessments (require 2/3 owner vote and declarant approval while declarant owns lots). Unpaid assessments become a lien on the lot and a personal obligation of the owner at the time they became due.
