Canyon Creek Apartments is a 25-unit affordable rental community in Casa Grande, AZ. This document is a regulatory agreement between the owner and the Arizona Department of Commerce, requiring that all units be rented to low-income households. It does not govern day-to-day resident conduct like pets or parking; rather, it sets income limits, rent restrictions, and tenant protections that bind the landlord.
- Affordability & income limits: 100% of units must be rented to households earning 60% or less of the area median income (AMI). Tenants must recertify income annually; if a tenant's income exceeds 140% of the income limit, the unit may be rerented to a non-qualifying tenant only after a comparable or smaller unit becomes available.
- Extended use period & duration: The affordability restrictions run through at least September 29, 2028 (the extended use period). The agreement may terminate earlier under foreclosure or if no buyer is found to maintain low-income status, but existing tenants cannot be evicted (except for cause) or face rent increases beyond Code limits for three years after termination.
- Renter protections: Low-income tenants cannot be evicted except for good cause. The landlord must accept Section 8 vouchers or certificates. Leases must include provisions for immediate termination if a tenant makes a material misrepresentation about income or fails to recertify annually.
- Income certification & monitoring: Each qualifying tenant must sign a Resident Certification Form and provide income documentation annually. The Department can inspect the property and records. The landlord pays an annual monitoring fee (lesser of $25 per low-income unit or $5,000).
