- Water supply fees: Each parcel is subject to a Replenishment Assessment (annual, based on water use), an Activation Fee (one-time per housing unit, due before public report), and a Replenishment Reserve Fee (due before public report; can be satisfied with long-term storage credits). Fees are set by CAWCD.
- Lien & personal obligation: Unpaid Replenishment Assessments become a continuing lien on the parcel and a personal obligation of the owner at the time the assessment came due. CAWCD has remedies under Arizona law.
- Amendment & termination: This declaration can be amended or revoked only by written agreement of CAWCD, the Arizona Department of Water Resources, and the owners of 67% of the total area of the property.
