This is a full set of Covenants, Conditions & Restrictions (CC&Rs) for Cahava Ranch Nature Preserve, a single-family residential community on approximately 130 acres in Cave Creek, Arizona. The rules bind all lot owners and are designed to preserve the natural desert environment, concentrate development, and protect wildlife habitat. The community is governed by the Cahava Ranch Property Owners Association.
- What you own & maintain: You own your lot, including any structures. Lot owners must keep their lot and improvements in good, safe, neat condition. The association maintains the common facilities (roadways, trails, easements) funded by assessments.
- Use restrictions: Building area cannot exceed 5% of the lot; cleared area (for driveways, pools, etc.) cannot exceed 25%. Protected areas (perimeter and restricted areas) must be left natural. Lots under 20 acres are limited to single-family residential or similar low-impact uses. One guest house is allowed for non-paying guests only.
- Architectural review: No structure or improvement may be built without prior written approval from the association or an architectural committee. Plans submitted are deemed approved if not ruled upon within 20 days. All exterior colors and materials must be compatible with the natural terrain (colors with light reflective value ≤60%, accent colors limited to 10% of surface areas).
- Easements & common facilities: The declaration creates easements for roadways, parking, shared driveways, pedestrian trails, recreation, utilities, and water systems. These are maintained by the association and may be used by lot owners, their occupants, guests, and invitees. The association may also grant access to adjacent landowners if they share costs.
- Assessments & fees: Annual assessments are based on allocation units (one unit per 10 acres of lot plus one per 7,000 sq ft of building area, capped). Assessments fund maintenance, insurance, and capital expenses. Unpaid assessments bear 12% interest and become a lien on the lot, subordinate only to first mortgages.
- Pets & animals: No livestock (horses, cattle, etc.) are allowed. Pets are limited to household pets kept within the building envelope, must be confined to pens/enclosures, and cannot roam freely in protected areas. Commercial breeding is prohibited. Pets must be under control on trails.
- Vehicles & storage: All vehicles, including boats, trailers, RVs, and trucks, must be stored within the building envelope and screened from view (up to 6 feet above the lot perimeter) by natural terrain, native vegetation, or enclosures finished in compatible colors.
