What Red Dog Ranch's governing documents say
Red Dog Ranch is a single-family home subdivision in Cave Creek, AZ, with 72 lots. These Covenants, Conditions & Restrictions (CC&Rs) govern what you can build and do on your lot. There is no homeowners' association in these documents; instead, an Architectural Control Committee (ACC) oversees exterior changes and enforces the rules. The CC&Rs run with the land and bind all owners.
- Architectural review: No exterior alterations (buildings, fences, walls, antennas, satellite dishes, color changes, etc.) may begin without written approval from the Architectural Control Committee (ACC). Submit plans and specifications; the ACC has 45 days to reject them, or they are deemed approved. The ACC may charge a consultant fee to review submissions.
- Use of lots (single-family only): All lots must be used for single-family residential purposes only. No condominiums, no partitions of a lot (except adjacent owners may split a vacant lot). Business activity is allowed inside a house only if it is not detectable from outside and conforms to zoning.
- Minimum house size & height: Every house must have at least 2,000 square feet of livable space on the ground floor (excluding garages, porches, patios, etc.). No structure may exceed 30 feet in height, measured from natural grade to the highest point (including antennas, chimneys).
- Setbacks & building envelope: No improvements (except approved driveways, lighting, and mailboxes) are allowed within 60 feet of front or back lot lines or 30 feet of side lot lines. Development is further restricted to designated building envelopes and must not disturb wash/riparian areas, floodways, or drainage easements.
- Pets & animals: Customary household pets (dogs, cats, birds, rabbits) are allowed but must not create a nuisance. On specified lots (list of 28 lot numbers), owners may keep up to four horses, burros, or donkeys. No cows, bulls, or other bovines are permitted anywhere in the subdivision.
- Signs: Only one 'For Sale' or one 'For Rent' sign per lot, not exceeding 5 square feet, is allowed. No other commercial signs are permitted.
- Elevations & color combinations: No two adjacent lots may have identical house elevations or color combinations. Also, no identical elevations or color schemes may be placed on lots separated by a street or where the closest front corners are less than 250 feet apart.
- Amendments & duration: The CC&Rs have an initial term of 35 years from recording (1995), automatically renewing for 10-year terms unless revoked by 75% of lot owners within 90 days of expiration. Amendments require the written consent of at least 67% of lot owners.
