What Cholla Condominium's governing documents say
Cholla Condominium is a 4-unit condominium community in Cave Creek, AZ, developed by Habitat for Humanity Desert Foothills. The declaration creates a condominium regime governed by the Arizona Condominium Act. Each unit has an equal 25% interest in common elements and votes. Leasing is prohibited while Habitat holds a first mortgage; after that, leases must be at least 90 days. A maximum of one dog weighing under 25 pounds is allowed, and modifications require board approval.
- What you own & maintain: You own the interior of your unit (from unfinished surfaces inward). The association maintains common elements (building exterior, roof, landscaping, private drives, sprinkler system). Unit owners maintain their unit interior and limited common elements (patio, windows, doors, HVAC, water heater).
- Leasing & rentals: While Habitat is the first mortgagee, leasing is entirely prohibited. After Habitat is no longer first mortgagee, unit owners may lease their entire unit for a term of at least 90 days. A copy of the lease must be provided to the association at least 10 days before occupancy, and the owner remains liable for any violations by tenants.
- Pets: Only one dog per unit, weighing no more than 25 pounds, is allowed (except service animals). Pets must be leashed (≤6 ft) outside, not left unattended, and owners must clean up waste. No pet structures visible from outside.
- Parking & vehicles: Commercial vehicles, RVs, boats, trailers, etc., are generally prohibited except for temporary loading/unloading (max 8 hours). Family vehicles (cars, pickup trucks under 1 ton, SUVs) are allowed. No vehicle repairs (except emergency) or storage of inoperable vehicles. Parking only in designated stalls; violations may result in towing at owner's expense.
- Modifications & alterations: Structural modifications require prior board approval, including engineer certification, indemnity, and possible security deposit. Nonstructural interior changes not affecting mechanical systems don't need approval. Any change visible from the exterior needs board approval. Hard flooring above ground floor is considered structural and requires sound dampening. While Habitat is first mortgagee, its consent is also needed for any modification to the unit or common elements.
- Use restrictions: Units are for single-family residential use only. Home businesses are allowed only if not detectable from outside, no retail traffic, and no flammable materials. No signs (except approved), no antennas/satellite dishes without board approval, no nuisances or offensive activity. Window coverings must be approved; reflective materials and window tinting (except original) are prohibited.
- Assessments: Common expenses are allocated equally among the four units (25% each). The board adopts an annual budget and levies common expense assessments. Special assessments may be levied. Enforcement assessments can be imposed for violations. Assessments secured by a statutory lien; nonpayment may lead to foreclosure.
