What Poquito Valley's governing documents say
Poquito Valley is a subdivision in Chino Valley, AZ, governed by recorded covenants, conditions, and restrictions (CC&Rs) that run with the land. There is no homeowners' association or common assessments; restrictions are enforced by property owners.
- Minimum lot sizes: Lots generally must be at least 5 acres. In Sections 23 and 26 of Township 15 North, Range 1 West, no lot may be subdivided smaller than 10 acres until May 10, 2003.
- Minimum dwelling size: Dwelling units must have at least 720 square feet of livable space. In Sections 23 and 26, the minimum is 1,100 square feet, and each such dwelling must have an attached garage or carport. A second dwelling unit on a lot in those sections may be as small as 720 square feet.
- Use & animals: Only domestic farm animals and commonly accepted household pets are allowed, except that cows, horses, and sheep may be kept commercially in Sections 23 and 26. Swine may be kept for non-commercial purposes on parcels of at least 40 contiguous acres.
- Vehicles & parking: No motor vehicle may be repaired, serviced, or rebuilt outside an enclosed garage. No high-intensity lighting may shine on neighboring lots.
- Temporary structures & mobile homes: No tents, shacks, garages, barns, or temporary buildings may be used as residences. Mobile structures (travel trailers, campers, etc.) with less than 720 square feet may be occupied for no more than 30 days out of any 365 consecutive days.
- Setbacks & height: No structure (except perimeter walls or fences) may be closer than 60 feet to any property line. Maximum building height is 35 feet from natural ground. No more than two dwelling units per five contiguous acres (except on Parcels 4A-4D).
- Party walls: Owners of contiguous lots share the right to use party walls or fences, and must equally share the cost of repair unless damage is caused by one owner's act.
- Amendment & term: The Declaration runs until January 1, 2088, then renews automatically for 25-year periods unless terminated by owners holding a majority of the acreage (90% vote required for early termination). Amendments require approval of owners holding a majority of the acreage, and Developer retains veto power so long as it owns any portion of the Property.
