This is a shared well agreement for Dream Catcher Ranch, a rural subdivision in Chuichu, Arizona. It binds property owners to rules for using a community well; it is not a full HOA or condominium regime.
- Well ownership & board: No more than 10 owners may share the well. Each parcel owner automatically holds one share and is a member of a Board of Trustees, which manages the well. A Chief Trustee is elected annually; initial Chief Trustee is Thomas Nicholls until the first meeting.
- Fees & deposits: Each owner pays a $40 monthly maintenance fee. A $100 deposit is required before receiving water service, refundable without interest upon sale. Late payments after 15 days incur a $25 fee, and the board may require an additional deposit equal to one month's average use.
- Water usage limits: Water is metered per owner. An excessive use fee of $2 per 1,000 gallons applies for consumption over 20,000 gallons per month. The board may limit water use equally if needed.
- Restrictions on property division & leasing: No owner may consolidate or subdivide their property by conveying or leasing any portion. Doing so cancels the owner's well interest without compensation, and the owner must provide an alternate water source.
- Amendment & termination: The agreement can be amended by a two-thirds vote of all owners, recorded in Pinal County, but not until Thomas Nicholls is repaid in full. The well may be conveyed to a Domestic Water Improvement District by a two-thirds vote, ending the agreement.
