Desert Horizon Condominiums is a 12-unit condominium community in Fountain Hills, AZ. You own your individual unit and an undivided 1/12 interest in the common elements, which the association maintains and insures through per-unit assessments. This document is the full set of rules for owners, residents, and their guests.
- What you own & maintain: You own the interior space of your unit (walls, floors, ceilings) along with an assigned patio/balcony and parking space. The association maintains all common elements (land, stairs, roofs, central utilities, parking areas). You are responsible for interior maintenance, separate AC/water heaters, windows, and any limited common areas.
- Use of units: Units are for single-family residential use only. No trade or business is allowed unless not detectable from outside, conforms to zoning, and involves no customers or solicitation. No more than 4 persons may reside in a unit at one time.
- Pets: No dogs are allowed. A cat or bird may be kept only with board approval and must stay inside the unit. The board may order removal if the animal becomes objectionable. No other animals or birds may be raised, bred, or kept.
- Leasing & rentals: Leases must be for at least 20 days (no transient or hotel use). Owners have the absolute right to lease, provided the lease complies with all governing documents and association rules.
- Vehicle restrictions: No trailers, campers, mobile homes, commercial vehicles (except standard pickup trucks used for business and personal use with unobtrusive signs), inoperable cars, boats, or motorcycles may remain on the property except temporarily for loading/unloading or in an enclosed garage/carport or designated area. No noisy or smoky vehicles allowed.
- Architectural control: No exterior alterations, improvements, fences, awnings, or landscaping visible from the street/common elements may be made without written approval from an Architectural Control Committee (3-5 members). Plans must be submitted for approval. Foil/darkening screens on windows are prohibited; no clotheslines or laundry drying outside.
- Assessments & insurance: Annual assessments are set by the board and cannot increase or decrease more than 20% from the prior year without 51% owner vote. Special assessments for a year may not exceed 5% of budgeted expenses without a 51% vote. The association carries liability and 'bare walls' hazard insurance; owners must insure their own improvements, floor/wall coverings, and personal liability.
