Plaza Del Lago is a condominium community in Fountain Hills, AZ — you own your individual unit and an undivided share of the common elements. The condominium declaration governs the rights and obligations of unit owners, residents, and the association. It covers use restrictions, maintenance responsibilities, assessments, and rules for renting, pets, parking, and alterations.
- Residential use & home businesses: Units must be used exclusively as residences. A home-based business is allowed only if it is not detectable from outside the unit, complies with zoning, does not involve customer visits or solicitation, and is consistent with the residential character of the community.
- Pets: No more than two domestic pets (dogs or cats) per unit. Pets must be kept as household pets only, not for commercial purposes. Dogs must be leashed outside the unit, and owners must immediately remove feces from common areas. Pets must not create noise or odor nuisances.
- Leasing & rentals: Unit owners may lease only the entire unit (no partial leases). Leases must be in writing and include a provision that the lease is subject to the declaration and rules. The owner must provide the association with lease dates, tenant names, owner contact info, and emergency contact at least 10 days before occupancy. Subleasing and lease assignments are prohibited. The owner is liable for tenant violations.
- Parking & vehicles: No trucks, trailers, campers, boats, recreational vehicles, or inoperable vehicles may be parked or stored on the property except inside garages. Parking is allowed only in designated spaces. Vehicle repairs (except emergency) are prohibited. The association may tow violating vehicles at the owner's expense.
- Antennas, signs & window coverings: Outdoor antennas and satellite dishes are prohibited without board approval. Signs, including 'For Sale' or 'For Rent' signs, are limited to a name/address sign no larger than 9x30 inches. Window coverings visible from the exterior (blinds, shades, reflective materials) require prior board approval.
- Alterations & improvements: Nonstructural interior alterations do not need board approval, but the owner is responsible for any resulting damage. Structural changes, exterior alterations (including patio enclosures), and any work visible from outside require prior written approval from the board. No changes to common elements without board approval.
- Maintenance responsibilities: The association maintains all common elements, including exterior building surfaces and landscaping. Each unit owner is responsible for maintaining the unit's interior, as well as limited common elements assigned to the unit (e.g., patio, exterior doors, windows, and their frames). Owners must also maintain any utility fixtures serving only their unit.
- Assessments & fees: All 44 units share common expenses equally (1/44 each). The board sets annual budgets and may adjust assessments during the year. Special assessments for capital improvements require approval by two-thirds of unit owners voting. Unpaid assessments accrue interest, late fees, and become a lien on the unit.
