What Lamont Twin Homes's governing documents say
Lamont Twin Homes is a 2-unit condominium community in Fountain Hills, AZ — you own your unit individually but share ownership of the building's common elements, which the association maintains and insures. This declaration governs everything from pets and parking to leasing and assessments. The rules apply to unit owners, and by extension to tenants and guests.
- What you own & maintain: You own the interior of your unit (walls, floors, finishes). The association maintains the building's structure, roof, and common elements. Limited common elements like patios and external fixtures are your responsibility to maintain.
- Pets: Only unit owners may keep a pet — renters and guests cannot bring animals. Limit is one domestic pet per unit, max 60 pounds. Dogs must be leashed (6 ft max) when outside and cannot relieve themselves on common elements.
- Leasing & rentals: You may only lease the entire unit (no partial leases). Leases must be in writing and include a provision that the tenant must follow all governing documents. You must notify the association of the lease start/end dates and tenant names. No minimum lease term is specified.
- Architectural review: Nonstructural interior changes are allowed without approval. Structural changes or any exterior alteration (visible from outside) require prior written approval from the Architectural Committee. An engineer's certification is needed for structural work.
- Parking & vehicles: Park only in designated spaces. No commercial vehicles, inoperable vehicles, boats, or trailers allowed (except temporary parking). The board can regulate parking, impose fines, and tow violators at the owner's expense.
- Assessments & fees: Each unit pays an equal share of assessments. The initial maximum annual assessment is $1,200 per unit; increases are tied to the Consumer Price Index or require a 2/3 vote. Delinquent assessments incur interest (12% per year) and a $10 late fee.
- Use restrictions: Units are for single-family residential use only. No businesses, no outside clotheslines, no high-intensity lighting visible from other units, and no nuisance activities. Solar panels, satellite dishes, and signs on the exterior are prohibited without approval.
