Villa De Luna is a condominium community in Fountain Hills, AZ — you own a specific unit and a 1/11th undivided share of the common elements. The association maintains the exterior and shared areas; you are responsible for the interior of your unit. This 1974 declaration sets the basic rules for use, maintenance, assessments, and leasing.
- What you own & maintain: You own your unit's interior (walls, floors, ceilings) and are responsible for its maintenance and repairs, including interior surfaces. The association maintains the exterior walls, roof, common elements, and all utility lines serving more than one unit.
- Use restrictions: Each unit may be occupied only by a single family as a residence. No business activities, transient rentals, or subdividing units are allowed. No nuisance or unlawful use is permitted.
- Leasing & rentals: Entire units may be rented only to a single family. No rooms may be rented separately, and no transient tenants are allowed. Leases must be for the entire unit.
- Pets: Household pets (dogs, cats) are allowed, but not for commercial purposes. Pets are not allowed on the common elements except as permitted by association rules. No livestock or poultry.
- Parking & vehicles: Each unit may have no more than two motor vehicles, parked only in the owner's assigned parking structure. Boats, campers, and trailers must be kept covered in designated areas. Trucks over 3/4 ton are prohibited from the property.
- Assessments & fees: Each unit pays 1/11th of total common expenses, determined annually by the board. Monthly payments are due in advance; if unpaid within 20 days, interest of 8% per annum accrues and a lien may be placed on the unit.
