Mirage Condominiums LVI is a 2-unit condominium in Fountain Hills, Arizona. You own your individual unit and share ownership of the building's common elements, which the association maintains. You must carry mandatory liability insurance, share common expenses equally, and comply with strict architectural restrictions and use limits.
- What you own & maintain: You own your unit's interior and exterior surfaces (walls, roof, slab); you also own a share of common elements like parking, sidewalks, and landscaping. You're responsible for maintaining and repairing your unit interior and any limited common elements allocated to you (such as your yard or patio). If the association neglects common elements, each owner must maintain the shared areas directly adjacent to their unit.
- Residential use only: Units are exclusively for single-family residential use. No gainful occupation, business, trade, or professional services can be conducted from your unit, though you may keep personal business records or take personal calls there.
- Maintenance liability & damage claims: You are liable to the association and the adjoining unit owner for any damage to common elements or shared improvements caused by your negligence or willful conduct. The association or adjoining owner can demand full payment for repair costs, and may pursue collection through legal action.
- Insurance requirements (mandatory): You must maintain fire, casualty, and liability insurance on your unit at full replacement value, certified by an insurer rated B+ or better. Both unit owners jointly must maintain at least $500,000 in liability coverage, with costs split equally between them.
- Common expense assessments: Annual common expenses are assessed equally to all units based on the annual budget adopted by the board. Assessment liens are subordinate to first mortgages, meaning foreclosure buyers acquire title free of unpaid assessment debts, which are then reallocated to remaining units.
- Architectural review & design restrictions: You must obtain prior written approval from the adjoining unit owner before making structural alterations or changing external colors/textures. Solar panels, satellite dishes, and antennas are prohibited if visible from neighboring property. All utility lines must be underground or concealed. The community is also subject to the Fountain Hills Committee of Architecture, whose more restrictive rules prevail.
- Parking, vehicles & outdoor storage: No automobile repair is permitted if visible from neighboring property. Inoperable vehicles cannot be stored or parked if visible from neighbors. During the marketing period, the declarant may reserve common parking spaces for sales purposes.
- Governance & amendment rights: During the initial "Period of Declarant Control" (90 days after all units are conveyed to owners), the declarant appoints the board. Once this period ends, unit owners elect a board of at least two unit owners. Any amendment to the declaration requires unanimous (100%) consent of all unit owners. First mortgagees have approval rights over material amendments affecting assessments, voting, insurance, or other core terms.
