What Via De Rico's governing documents say
Via De Rico is a small homeowners association (HOA) for just four custom-home lots (Lot 1–4) in Gold Canyon, AZ. These Covenants, Conditions, Restrictions, and Easements (CC&Rs) bind all owners and govern architecture, landscaping, parking, and use of the properties. It is a single-family residential community with a strong focus on desert aesthetics and rural character.
- Architectural design & style: Homes must be custom-built, minimum 2,300 sq ft of livable area, and follow one of these approved architectural styles: Adobe, Arizona Ranch, Desert Classic, Desert Contemporary, Desert Rustic, Southwest Rustic, Southwest Territorial, Tuscan, or Mediterranean. Mobile homes and prefabricated homes are prohibited.
- Height restrictions: Homes and buildings on Lots 1, 3, and 4 cannot exceed 20 feet in height; Lot 2 is limited to 35 feet.
- Landscaping & natural areas: Front yards must be natural Sonoran Desert landscaping. Non-desert vegetation (e.g., grass) is allowed only in backyards if enclosed by a fence. Protected native plants may not be damaged or removed, though they can be relocated within the building envelope. Perimeter fences between lots are prohibited.
- Parking & vehicles: Each residence must have an enclosed garage for at least 2 automobiles and provide at least 2 additional off-street guest parking spaces. On-street parking is not permitted. Motorhomes, campers, boats, and other recreational vehicles may be stored on a concrete pad if enclosed by a fence, garage, or other acceptable building.
- Animals: No horses, livestock, or large animals are allowed. Continuously barking dogs must be muzzled or kept indoors to avoid nuisance.
- Building envelope & setbacks: All improvements must be built within a designated Building Envelope, with construction activity kept at least 5 feet inside that line. Minimum setbacks from lot lines (per Pinal County GR zoning) are 40 feet front, 20 feet side, and 40 feet rear.
- Construction timeline: There is no deadline to start building, but exterior construction must be completed within one calendar year from groundbreaking.
- Assessments & amendments: Special assessments are made as needed and divided equally among all residents using the road or utilities. Additions to the governing documents require a simple majority vote of the Resident Owners of Lots 1–4.
