This is an amendment to the covenants for Acacia Crossing-Buckeye, a standard single-family homeowner association (HOA) in Komatke, AZ. It only covers architectural control rules, not the full declaration. Homeowners must get prior approval for most exterior changes that are visible from neighboring properties.
- Architectural review: Any visible exterior change, including devegetation (except weeds), excavation, grading, or altering the appearance of a lot or building, requires prior written approval from the Architectural Committee. Submit plans with details; the committee must approve or deny within 45 days or it’s deemed approved. The committee has sole discretion over aesthetics and harmony with the community.
- Review fee: The Architectural Committee may charge a fee for reviewing each application, which can include actual or estimated costs for consulting with an architect or engineer.
- Conditional approval & bonds: Approval may be conditioned on posting a bond or security to ensure completion of improvements or repairs of any damage to Association areas. The bond is refundable upon completion and written request, provided no damage occurred.
- New construction & relocation: All improvements on lots must be new construction; no buildings may be relocated onto a lot from elsewhere (except the declarant can place sales or construction trailers).
- Committee composition & authority: The declarant (developer) appoints and controls the Architectural Committee while it owns any lot. Afterward, the Board appoints committee members. The committee can adopt architectural guidelines and delegate decisions to subcommittees.
