What The Acacia Condominiums's governing documents say
The Acacia Condominiums is a 19-unit condominium community in Phoenix, Arizona — you own your individual unit and share undivided ownership of the common elements with all other unit owners. The association maintains the common areas, carries master insurance, and enforces the rules. This document, the Condominium Declaration, governs all owners, lessees, and occupants.
- What you own & maintain: You own the interior surfaces of your unit (walls, floors, ceilings, fixtures serving only your unit). The association maintains all common elements (exterior walls, roof, common areas, infrastructure). You are responsible for maintaining any limited common elements assigned to your unit, such as a balcony or patio, and for repairs inside your unit.
- Use restrictions: Units are for residential use only, by a single family (related persons or up to four unrelated persons). Home businesses are permitted only if they are not detectable from outside, do not generate extra traffic, and comply with all rules. No signs, antennas, or satellite dishes may be installed without board approval.
- Leasing & rentals: You may lease your unit, but the lease must comply with the declaration and any association rules. The document requires that lessees abide by all rules, and under certain circumstances the owner may be limited in using recreational amenities while the unit is leased. Specific lease term minimums are not stated in this excerpt.
- Pets: A reasonable number of domestic pets (dogs, cats, fish, or birds commonly kept as household pets) is allowed. No breeding for commercial purposes. Dogs must be leashed outside and waste removed immediately. The board may restrict dogs of breeds deemed dangerous.
- Alterations & improvements: Nonstructural interior alterations generally do not need board approval, but structural changes or anything visible from the exterior requires prior written board approval. The board may require plans, deposits, and insurance. You are liable for any damage caused by your alterations.
- Assessments & fees: Each unit pays an equal share of common expenses (regular assessments) plus possibly special assessments, individual expense assessments, and enforcement assessments. Assessments are a lien on the unit. Delinquency can lead to late fees, suspension of voting rights, and foreclosure.
- Common elements & voting: You have a 1/19th undivided interest in the common elements, one vote in the association, and a non-exclusive easement to use common areas. The board may adopt rules and suspend your use of common elements for violations.
