Quail Haven is a single-family residential community in Marana, AZ, designed as a refuge for people with Multiple Chemical Sensitivity (MCS). The deed restrictions require at least one resident in each home to have MCS. The community emphasizes non-toxic living, with strict bans on pesticides, artificial fragrances, and other chemical exposures.
- Residency requirement (MCS): At least one resident of each home must have MCS. Exceptions require a vote of all lot owners (consensus minus one). Heirs may live in the home if they have MCS, or rent to someone with MCS.
- Leasing & rentals: Leases must be at least 6 months. Renters must have three good references and sign a rental agreement. Renters must carry personal property insurance. Any rental rules are determined by lot owners (consensus minus one).
- Pets: No swine, cattle, horses, or goats allowed. No attack dogs. Only two dogs per lot (except Declarant). Dogs must be fenced or leashed, and waste must be bagged every other day. No roosters, but chickens are permitted.
- Building & architecture restrictions: Only single-story, site-built homes using masonry materials (adobe, stone, stucco, etc.). Maximum home size: 2,000 sq ft (including garage). Roofs must be tile, concrete, or metal (no flat roofs). Colors must be earth tones (LRV ≤ 65). No prefabricated, modular, or manufactured homes. Building plans require Declarant approval.
- Chemical & fragrance restrictions: No pesticides, herbicides, or chemical fertilizers. No artificial fragrances (perfume, scented laundry products, etc.). No smoking, burning, or petroleum-fueled generators. Only low-VOC paints allowed. Outgassing items must be placed out of sight.
- Landscaping & vegetation: No high-allergen plants (ragweed, desert broom, pampas grass). Minimum planting of 5 ocotillo, 2 mesquite (≥5 ft), 2 barrel cactus, and 4 hedgehog cactus (≥7 in) per lot. No lawns except with low-allergen grasses. Gray water or harvested rainwater must be used for irrigation.
- Vehicle & parking restrictions: Parking only in garages, carports, or driveways. No parking on roads except emergencies or social functions. Recreational vehicles and boats must be screened from view. No inoperable vehicles visible. Speed limit 8 mph. Motorcycles and ATVs for recreation prohibited.
