This is a supplemental declaration for a specific parcel (Parcel T1) within the DC Ranch master-planned community in Scottsdale, AZ. It adds to the master declarations (Council Declaration, Ranch Declaration, and The Covenant) and applies to the 29 single-family lots in this parcel. This document does not contain the full community rules; the master declarations govern broader association matters like architectural review, assessments, and common area maintenance.
- Land use & development: The parcel is designated single-family residential. Lots are limited to detached single-family dwellings and related common elements. Declarant retains rights to build temporary sales/construction trailers and model homes.
- Assessments & fees: Lots are subject to assessments under the Council Declaration and Ranch Declaration (general and neighborhood assessments). Assessments begin 18 months after recording the supplemental declaration or when the first lot with a completed residence is sold, whichever is earlier. The Ranch Association may levy separate Neighborhood Assessments for Parcel T1 and for Planning Unit V (including private streets, guardhouses, parks).
- Owner maintenance responsibilities: Each lot owner must maintain all improvements, landscaping, and natural open space within the lot. Owners are also responsible for maintenance of adjacent ‘Streetscape Areas’ (landscaped areas between private street improvements and the lot). If an owner fails to maintain, the Ranch Association may enter the lot to perform maintenance and charge the owner.
- Walls & shared driveways: Boundary walls (between lot and common area) and common yard walls (between two lots) are jointly maintained by the affected parties, with specific rules for damage from wear and tear or owner/association acts. Driveway improvements in cross-access easements are maintained by the Ranch Association (except damage caused by a lot owner). No modifications to walls or driveways without approval.
- Airport proximity & noise: Lots are within 2 miles of Scottsdale Airport. Owners acknowledge aircraft noise, flight paths, and operations (day/night, projected increase). By taking title, owners waive claims against the City of Scottsdale, the developer, and the community associations related to airport operations.
- Enforcement: The Community Council (or delegated Ranch Association) may recover costs for maintenance performed on an owner’s behalf and may impose a specific assessment against the owner’s property, due immediately upon notice.
