What Boulder Views's governing documents say
Boulder Views is a single-family home subdivision in Mesa, Arizona, governed by a homeowners association (HOA). These Covenants, Conditions & Restrictions (CC&Rs) apply to all lot owners and establish rules for construction, use, and maintenance to preserve the upscale desert character of the community.
- Architectural & design standards: Homes must be at least 3,500 sq ft (3,000 on ground floor if two-story), built in designated architectural styles (Tuscany, Santa Fe, etc.), with a minimum three-car garage, clay/concrete tile roofs, and no composition siding. All exterior alterations require prior written approval from the Architectural Committee, with a $500 review fee.
- Landscaping & lot maintenance: Front yard landscaping must be completed within 90 days of dwelling completion, including at least two 36-inch box trees. Owners must keep lots free of debris and weeds; the Association may perform maintenance and charge the owner as a lien. Clotheslines are prohibited unless retractable; reflective window covers are banned; trash containers must be screened from view.
- Vehicles & parking: Cars, vans, and pickup trucks (1-ton capacity or less) must be parked in the garage; two vehicles may be on the driveway. No street or common area parking for more than 4 hours. Boats, RVs, trailers, and campers are prohibited without Architectural Committee approval. Abandoned or in-repair vehicles must be stored in an enclosed garage.
- Pets: Up to three household pets (cats, dogs, etc.) are permitted, but no breeding or commercial purposes. Dogs must not stray onto other lots, and owners must keep pets quiet. No livestock or poultry.
- Assessments & fees: Annual regular assessments initially capped at $1,200 per lot, payable quarterly, with annual increases limited to 10% or CPI (whichever is higher) unless 51% of votes approve a larger increase. Special assessments require majority vote. A one-time reserve fund fee of $500 per initial purchaser. Late payments incur 12% annual interest and a $25 late fee; unpaid assessments become a lien on the lot.
- Homeowners association & common areas: The Boulder Views HOA enforces the CC&Rs, maintains common areas (Tracts A–D), and carries liability insurance. Each lot owner is a member with one vote. Owners have an easement to use common areas. The Association may adopt rules and impose fines as special assessments.
