What Signal Heights's governing documents say
Signal Heights is a single-family home subdivision in Mesa, AZ, governed by a Declaration of Restrictions (CC&Rs) recorded in 1981. There is no formal homeowners association — the rules are enforced by lot owners themselves. These restrictions run with the land until 2015 and auto-renew every 10 years unless changed by a majority vote.
- Land use & building type: Lots are for single-family detached dwellings only, max 2 stories. Minimum dwelling size: 1,400 sq ft for fewer than 3 bedrooms, 1,600 sq ft for 3+ bedrooms (excludes open porches, patios, carports, garages). No mobile homes, tents, or trailers as residences.
- Setbacks & construction: Front wall at least 30 ft from front property line, side walls at least 10 ft (15 ft if facing a street), rear wall at least 30 ft. Exterior materials must be new first-class; roofs cannot be tin, aluminum, or steel (except FHA-approved). Construction must be completed within 12 months.
- Architectural review: Plans and specifications must be approved in writing by the Architectural Control Committee (initially Signal Heights Company officers) before building or altering any structure. Approval or disapproval must be given within 30 days of submission; if no response, approval is deemed given unless a lawsuit is filed before completion.
- Fencing & walls: Fences, walls, and hedges require written approval from the Architectural Control Committee. Allowed materials: masonry, wood, or steel pipe; no barbed wire, woven wire, or chain link. Maximum height 6 ft; no solid fencing over 3.5 ft closer to the front street than the front wall of the dwelling. On corner lots, sight-distance triangles apply.
- Property maintenance: All lots must be kept free of rubbish and litter; weeds and grass must be maintained. During absences, the owner must arrange for care. Six lot owners acting together can have a neglected lot cleaned and file a lien for the cost.
- Parking & vehicles: No overnight parking of trucks, pickup trucks, or trailers in the street. Only passenger cars and pickups may be parked in open carports. Abandoned or inoperable vehicles must not be visible from other lots or streets.
- Signs: One sign per lot advertising sale or rent is allowed, max 5 square feet. Builders may have a sign during construction with committee permission. No other signs are permitted.
- Pets & livestock: No livestock or poultry. Dogs, cats, and other small household pets are allowed as long as they do not cause annoyance and are not kept for commercial purposes.
