Colony Biltmore Greens is a single-family homeowners association (HOA) in Paradise Valley, AZ. These documents include the HOA's CC&R violation enforcement policy, bylaws, architectural request form, and design guidelines that govern property modifications, landscaping, and community behavior. They apply to all homeowners and, where noted, to tenants.
- CC&R Violation Penalties & Process: Non-monetary violations get a first notice with 14 days to comply, a second notice with 7 days, then a $25 penalty with 7 days, and a fourth notice with a $50 penalty. Fines accumulate for continuing violations.
- Architectural Review Process: Any exterior change visible from the street or neighbors must be approved in writing before work begins. Submit application with plans, materials, and photos to the Architectural Committee. Review takes up to 30 days; approval expires if construction doesn't start within 180 days. Construction must be completed within 12 months unless extended. Neighbor input may be sought. A $1,500 deposit is required for dumpsters or heavy equipment.
- Design & Exterior Restrictions: Approved paint colors are limited to specific Dunn Edwards shades (e.g., Whole Wheat, Stoneish Beige). No trim/accent colors. Roof must match approved Eagle Tile colors. Garage door replacement must be approved; vents not allowed. Gates must provide 90% screening. Courtyard walls 48-60 inches, pillars max 60 inches. Play structures over 6 feet prohibited. Decorative art, statuary, and colored bulbs (except holidays) not allowed in front yards.
- Landscaping Rules: Front yard landscaping is maintained by HOA (watering, trimming), but homeowners pay for plant replacement. Changes require committee approval. Approved decomposed granite color is Table Mesa Brown. No white/pink/blue/lava granite. Turf must not abut foundations. Landscape lighting must be 2700K warm.
- Parking & Construction Hours: Construction allowed Mon-Fri 7am-5pm, Sat 9am-3pm; no work Sundays or holidays. Contractors must post 'no parking' signs across the street. No construction materials or debris left in street overnight ($50 daily fine).
- Flags & Signs: Permitted flags: US, Arizona, military branches, POW-MIA, Gadsden, Arizona Indian Nation, and first responder/military support. No religious, political (except political signs allowed 71 days before/15 days after election, max 16 sq ft aggregate), or controversial flags. One flagpole allowed, height not above roofline. For Sale/Rent signs max 24x24 inches.
- Board Governance & Meetings: Annual meeting between Oct 1 and Dec 15. Board size 5-7 directors, 80% must be members, terms staggered (2 years). Quorum for member meetings is 25% of votes; by-mail vote quorum is 10% of class A and B ballots. Board regular meetings need 4 days' notice; special meetings need 3 days' notice to directors. Executive sessions allowed for legal, personnel, and violation appeals.
- Assessments & Delinquencies: Annual and special assessments are secured by a lien on the property. Unpaid assessments accrue 10% annual interest. Association can sue or foreclose, adding costs and attorney fees. No owner may waive assessments by non-use of common areas.
