Arizona Biltmore Hotel Villas Condominiums is a 74-unit condominium community in Phoenix, AZ. You own your unit and share ownership of common elements, which the association maintains. The document governs use, assessments, leasing, and architectural standards for unit owners.
- What you own & maintain: You own the interior space within your unit's boundaries (underside of ceiling, top of finished floor, interior of exterior walls). The association maintains all common elements, including porches, patios, and balconies as limited common elements assigned to your unit.
- Leasing & rentals: Leases must be for the entire unit, in writing, for a minimum of 30 days, and must state they are subject to the condominium documents. Leases must be through an approved leasing agent under the master association. Short-term rentals (under 30 days) are not allowed, except leases to the hotel or its affiliate.
- Pets: No animals may be raised, bred, or kept except in accordance with association rules and regulations. No animal may be kept for commercial purposes.
- Architectural review: An Architectural Control Committee appointed initially by Declarant reviews all exterior alterations and landscaping to maintain uniformity. Plans must be submitted; if no decision within 30 days, they are deemed approved. The committee can charge a processing fee.
- Parking & vehicles: Each unit has the right to one exclusive covered parking space on Parcel 2, assigned by the association. Parking rights cannot be separated from unit ownership. Storage of vehicles must comply with rules and regulations.
- Assessments & fees: Annual assessments cover common expenses; special assessments require approval by owners of at least 51% of total unit square footage. Late payments incur a 30% late charge and interest at 18% per annum or prime plus 5%. Delinquent amounts become a lien on the unit.
- Hotel amenities: Unit owners have no right to use the adjacent Arizona Biltmore Hotel's amenities (tennis courts, golf, pool, etc.). The hotel may allow use at its discretion, subject to charges, but the association and owners cannot advertise any affiliation with the hotel.
