It is not a homeowners association rulebook; instead, it permanently restricts the golf course properties to golf course and related uses (e.g., clubhouse, driving range, maintenance) or landscaped open space. The document grants a negative easement in favor of surrounding residential property owners, homeowners associations, and the City of Phoenix, giving them the right to enforce the restriction but no right to use the property. It binds current and future owners of the golf course land.
- Land use restriction: The Adobe Course and Links Course must be used only for golf course and related uses (e.g., clubhouse, restaurant, pro shop, parking, turf care, cart storage, snack bar, driving range, restrooms) and/or 'landscaped' open space (which may include drought-tolerant materials like xeriscape or granite). This restriction is perpetual and runs with the land.
- Benefited parties: The restriction benefits (a) all owners of residentially zoned property between Camelback Road and Lincoln Drive, 24th Street and 32nd Street, (b) homeowners associations with jurisdiction over abutting property and the Arizona Biltmore Estates Village Association, and (c) the City of Phoenix. These parties may enforce the restriction but have no possessory or use rights.
- Enforcement & legal recourse: If a lawsuit is filed to enforce the declaration (other than to determine whether open space is 'landscaped'), the prevailing party may recover costs and reasonable attorneys' fees. Any benefited party may, but is not obligated to, enforce the declaration. A failure to enforce does not waive future enforcement. All actions must be brought in Maricopa County, Arizona.
