What Biltmore Greens's governing documents say
This document is the 2006 Architectural and Landscaping Committee Rules for the Biltmore Greens III, IV, V, and VI homeowners association in Phoenix, AZ. It applies to homeowners who want to modify the exterior of their property, including buildings, landscaping, and hardscaping. The rules govern the approval process, design standards, construction conduct, and maintenance responsibilities. It does not cover other HOA rules such as assessments, pets, or leasing.
- Approval process: Homeowners must submit an Architectural and Landscaping Request Form with plans to the Committee. The Committee responds within 30 days. Approval is valid for one year; work must start within that year and be completed within set timeframes. Major changes require re-submission if approval expires.
- Design standards – buildings: Two-story homes are generally prohibited except on specific buffer lots. New additions have height limits: up to 13 feet for flat roofs (including parapet) on homes with pitched roofs, and up to 15 feet for flat roofs on homes with flat roofs. Pitched additions must match neighboring roof pitch. No mechanical equipment on roofs except small satellite dishes not visible from street.
- Design standards – landscaping: Trees and large shrubs must not block city, golf course, or mountain views from neighboring lots. Annual flowers do not need approval. Backyard changes generally don't need approval if not visible from street and don't cause nuisances. All landscaping must be suitable for Arizona climate.
- Construction conduct & contractor rules: Contractors must be licensed, bonded, and insured. Noise restrictions vary by season: e.g., May–Oct: no noise before 6am or after 5pm on weekdays, before 7am or after 4pm on Saturday, all day Sunday. Dumpsters allowed only in driveways for up to 30 days. Debris must be cleaned up daily. Construction fences required for large projects.
- Arroyos & common areas: Homeowners may not use arroyos (washes) or common areas for any purpose. Prohibited actions include dumping debris, chemicals, or pool backwash; installing plants or gates; allowing pets to defecate; or trimming plants without permission. The Association may trim arroyo plants if they cause damage or view impairment.
- Swimming pools: Must comply with City of Phoenix safety codes. Party walls can only be used as pool fencing with written consent of adjoining neighbor. Pool backwash must drain into sanitary sewer, not arroyos or streets.
- Enforcement & inspections: The Committee may inspect work in progress and after completion. Noncompliance notices require corrective action within 30 days. The Committee may require mediation before legal action. Final approval requires a final inspection.
