Biltmore Villas II is a homeowners association (HOA) in Scottsdale, AZ. This document is a set of board-adopted policies and procedures that supplement the CC&Rs, governing things like parking, pets, rentals, and exterior maintenance. It applies to all homeowners in the community.
- Late payments & liens: Assessments are due the 1st of each month. A $25 late fee is charged after 30 days. After 90 days delinquent, a lien may be placed following a 10-day notice. A personal judgment may be filed if the balance exceeds $1,000, also with a 10-day notice.
- Parking & vehicles: Parking is prohibited on North 28th Place and North 29th Place. From 11 PM to 7 AM, street parking is always a violation; from 7 AM to 11 PM, vehicles must be parked in the garage or driveway except for temporary needs (e.g., maintenance, deliveries). Fines escalate: first violation warning, second $50, third $100, then increasing by $50 per violation. Unpaid fines may lead to a lien.
- Pets & animals: Pets must be leashed when outside and are not allowed to run free. Owners must clean up waste immediately. If an animal creates a noise nuisance, the board may require the owner to correct the problem or remove the animal. Violations carry a $50 fine per occurrence.
- Renters & tenants: Homeowners must provide a signed tenant registration form acknowledging the CC&Rs and Policies & Procedures within 30 days of move-in. Failure to file results in a fine.
- Architectural review: Any exterior changes (including landscaping, painting, structures) require prior written approval from the Architectural Committee. Plans must be submitted, and the committee will respond within 30 days.
- Exterior painting & maintenance: The association coordinates painting of stucco, wood beams, garage doors, and front doors on a schedule (stucco/wood/garage doors every 3 years, front doors yearly). Between scheduled painting, the homeowner is responsible for all exterior maintenance and repairs. Reserves are built through monthly assessments; special assessments may occur if funds are insufficient.
- Tree replacement: If a tree in a common area is damaged through no fault of the homeowner, the association replaces it with a 15-gallon tree from the approved list. Homeowners may request a different tree or larger size at their own expense, subject to Architectural Committee approval.
- Realty signs: No signs offering property for sale or rent are allowed on the dwelling or lot, except 'OPEN HOUSE' signs while the owner or agent is present. No more than two directional signs may be placed on community property. Fines start at $50 and increase by $25 every 7 days if not removed.
