Biltmore-Greens III is a single-family residential homeowners association in Phoenix, AZ. This document is a 2006 amendment to the community's Covenants, Conditions & Restrictions (CC&Rs) — it modifies specific rules but does not contain the full set of governing rules. It updates rules on home businesses, building heights, lot maintenance, pet leash requirements, parking, motorized devices, arroyo protection, board eligibility, fines, and dispute mediation.
- Home-based businesses: Businesses may be conducted in a residence only if they are not apparent from sight or sound, involve no customer traffic (average ≤1 customer per week), no signage, no retail front, and no hazardous materials. Leasing to a single family is still allowed.
- Building height & architectural restrictions: Two-story residences are prohibited except on specified lots (Lots 165-170 and 3-9). No new or altered residence may become two stories on other lots.
- Lot maintenance & landscaping: Owners must keep all visible portions of their lot neat and tidy, including back and side yards. Items like pool equipment, toys, laundry, and faded patio furniture must not be visible from neighboring property or the street. Owners are responsible for tree maintenance and damage from their landscaping. No landscaping changes in arroyos or common areas without Architectural Committee approval.
- Pets & leash rules: Dogs and other pets must be on a leash at all times unless in a fully enclosed fenced yard. Owners must clean up after pets everywhere on Association property. Pets must not make excessive noise.
- Parking & garages: No vehicle covers in driveways or streets. Driveway and street parking is primarily for guests. Long-term parking outside the garage is allowed only if the owner has more vehicles than fit in the garage, and then limited to one vehicle per lot (parked in the driveway, not the street). Garages must first be used for parking vehicles before storage.
- Motorized devices: Motorized skateboards, scooters, and similar devices are prohibited within the property, except those required for persons with disabilities.
- Arroyo & common area use: No draining (except storm/potable water), backwashing, dumping, or littering into arroyos or common areas. No storage of household items or building materials in arroyos or common areas. The Association may remove and discard any such items at the owner's expense.
- Board eligibility & enforcement: Owners more than 30 days delinquent in assessments or in violation of CC&Rs or laws are ineligible to run for or serve as a director or committee member. The Association may impose fines for uncured violations after notice and may recover attorney's fees and costs in enforcement actions. Disputes between owners must go to mediation before a lawsuit, with mediation costs split equally among the involved owners.
