This is the Declaration of Covenants, Conditions and Restrictions (CC&Rs) for Sunrise at North Canyon, a single-family home community in Phoenix, AZ. It creates a homeowners association (Sunrise at North Canyon Association) and binds all lot owners to rules about assessments, property use, and architectural control.
- Membership & voting: Each lot owner is a member of the Association. There are two classes: Class A (all owners except Developer) with one vote per lot, and Class B (Developer) with three votes per lot until either the total Class A votes equal Class B votes or December 31, 1999, whichever comes first.
- Assessments: Annual assessments start at a maximum of $90 per lot and may increase up to 5% per year without a vote. Special assessments for capital improvements require a 2/3 vote of each class. Assessments are uniform per lot, due dates set by Board, and unpaid assessments bear 6% interest and become a lien on the property.
- Use restrictions: No exterior antennas, storage of trailers/boats/vehicles unless screened, garbage must be in screened containers, no outside speakers/amplifiers, no offensive lighting. Pets limited to 3 (dogs, cats, birds, fish) kept as household pets only. No re-subdivision, no burning except barbeques, signs limited to mailboxes, nameplates, and for-sale/rent signs per developer specs. No vehicle repairs in view. No oil/mineral operations. Parking only in garage or driveway; no buses, RVs, or commercial trucks unless screened.
- Architectural review: No building, fence, wall, or exterior alteration may begin without written approval from the Architectural Control Committee as to harmony of external design and location. Plans are deemed approved if the Committee does not act within 30 days. The Committee initially consists of Alan Hamberlin and later transitions to lot owners.
- Party fences: Owners of contiguous lots sharing a party fence have equal use rights. If an owner damages the fence, they must repair at their own cost. If the fence is damaged by ordinary wear or by someone else, all adjoining owners share the repair cost equally.
- Duration & amendments: These covenants run for 20 years from recording, automatically renewing for successive 10-year periods. They may be amended by a recorded instrument signed by a majority of lot owners. FHA/VA approval is required while Class B membership exists.
