What Carriage Square at Gainey Village's governing documents say
Carriage Square at Gainey Village is a homeowners association (HOA) in Phoenix, AZ covering 131 residential lots. You own your individual lot and residence; the Association maintains the common areas and amenities, funded by per-lot assessments. All owners automatically become Association members and are bound by these restrictions.
- What you own & maintain: You own your lot and residence; the Association maintains common areas and carries master insurance. You must keep your lot, home, and landscaping in good repair at your own cost.
- Fees & assessments: Annual assessments are set by the Board budget; they may increase by no more than 20% per year without an owner vote (increases beyond 20% need majority approval at a meeting with 25% quorum). Special assessments for capital improvements require majority owner vote. Enforcement assessments cover collection costs and attorney fees.
- Late payment consequences: Payments 15+ days late incur 10% annual interest plus a $15 late fee. Your voting rights are suspended if you're delinquent or in violation of the rules until all payments and defaults are current. The Association can foreclose a lien on your lot.
- Leasing & rentals: Rental leases must be at least 30 days—no short-term or vacation rentals. No subleasing. You must notify the Association 10 days before the lease starts, providing tenant names, emergency contact, and your own phone number.
- Pets: A reasonable number of dogs, cats, and household birds are allowed (the Board decides what's reasonable for your lot). Dogs must be on a leash no longer than 6 feet when outside. Animals cannot make excessive noise or cause odors.
- Vehicles & parking: Inoperable vehicles (flat/missing tires or outdated registration) cannot be parked on the property. Trucks, trailers, campers, boats, and RVs are prohibited except for up to 72 consecutive hours for loading/unloading, no more than twice per month. Minor repairs (oil change, tire) are OK; major repairs are not allowed.
- Architectural review & modifications: Board or Architectural Committee approval is required before any construction, modification, landscaping change, or front-yard tree planting. Applications are deemed denied if not approved or denied within 45 days. Approved work must start within 90 days or approval expires. No changes to approved plans without re-approval.
- Use restrictions & maintenance: Single-family residential use only—no business, trade, or occupation. Trash must go in designated containers. No nuisances (excessive noise, odors). All buildings, landscaping, and improvements must be kept in good repair and adequately painted. Sex offenders classified as Level 2 or 3 under Arizona law are prohibited from occupying any lot.
