Keresan Villas is a townhome community in Phoenix, AZ. You own your individual lot and townhouse, with shared party walls and common areas maintained by the homeowners association. This document is the full set of covenants, conditions, and restrictions governing the community.
- Townhome ownership & party walls: Each townhouse shares party walls with neighbors. If a party wall is damaged by an owner, that owner must repair it. If damaged by other causes, both adjoining owners share the cost equally. Any alteration to a party wall requires the adjoining owner's consent.
- Assessments & fees: Annual assessments are levied per lot, with a maximum of $600 initially. The board may increase assessments up to 3% per year without a vote; larger increases require a two-thirds vote of owners. Special assessments also require a two-thirds vote. Unpaid assessments bear 12% interest and can become a lien on the property.
- Architectural review: No exterior structures, additions, or alterations may be made without prior written approval from the Board or an architectural committee. Plans must be submitted; if no decision is made within 30 days, approval is deemed granted.
- Exterior & interior maintenance: The association maintains exterior building surfaces (paint, repair), trees, shrubs, walks, and common areas. Owners are responsible for roofs, gutters, downspouts, interior of the townhouse, patios, and any modifications they make (e.g., skylights, screened patios). Termite control is also the owner's responsibility.
- Use restrictions: Properties are residential only. Pets (dogs, cats) are allowed but not for commercial purposes. Home-based businesses are permitted if they are not detectable from outside, comply with zoning, and do not cause nuisance. No commercial vehicles over 3/4 ton, boats, trailers, or RVs may be parked. Only one small 'for rent' or 'for sale' sign (max 4 sq ft) is allowed. Antennas and satellite dishes must comply with board rules.
- Insurance: The association carries insurance on common areas and structural components of townhouses (full replacement cost). Each owner must insure their own interior, improvements, and personal property. The board can bill owners separately for insurance costs; unpaid amounts become delinquent assessments.
