What Sierra Bloom's governing documents say
Sierra Bloom is a commercial development (not residential) on tribal land in Phoenix, Arizona, under a 99-year lease through February 2104. This covenant document governs commercial developers and their tenants operating individual retail, medical, or care-facility parcels—not a guide for homeowners. The Administrative Agent enforces design standards and collects pro-rata assessments for shared infrastructure.
- Lease structure & term: The underlying land is leased for 99 years (expiring February 23, 2104). Individual commercial parcels are leased or subleased to operators; the covenants run for the full term and auto-renew in 20-year increments thereafter.
- Allowed commercial uses: Retail (shops, salons, escrow, restaurants) is permitted on designated Retail Parcels (Lots 1 and 11). Treatment and Care Facilities (hospitals, urgent care, assisted living, skilled nursing) and Personal Care Services Facilities are also allowed in some cases. Residential use is explicitly prohibited.
- Design & architectural approval: Developers must submit building elevations, site plans, and landscape designs to the Administrative Agent for written approval before construction. Designs must be architecturally compatible with the overall development. Retail Parcel designs are exempt from this review.
- Outdoor activities & noise restrictions: Most outdoor activities are prohibited. Exceptions include parking/deliveries, restaurant seating/service, recreational areas for care facilities, and connected patios. Exterior speakers are restricted; medical/emergency sirens are exempt.
- Parking & vehicular requirements: Each parcel must provide all required parking within its own boundaries; parking on another parcel is prohibited without a separate agreement. All parking areas must be paved with asphalt or concrete.
- Maintenance & common area operations: Owners maintain their own buildings and landscaping. The Administrative Agent maintains shared roads, utilities, landscaping buffers, and common areas, funded by pro-rata quarterly assessments based on parcel size.
- Assessments & delinquency: Owners pay quarterly pro-rata assessments (billed in advance) to cover administrative costs and infrastructure maintenance; the budget is set annually. Late or unpaid assessments incur interest and late charges; liens or lawsuits can be filed for collection.
