What Sierra Point's governing documents say
Sierra Point is a single-family home subdivision in Phoenix, AZ, governed by a homeowners' association (HOA). These Covenants, Conditions and Restrictions (CC&Rs) apply to every lot owner, lessee, and occupant. The HOA maintains common areas (Tracts A and B), and owners are responsible for their own lots, insurance, and compliance with architectural and use restrictions.
- Architectural review: Any exterior improvement visible from a neighboring property—including construction, additions, painting, or landscaping—requires prior written approval from the Architectural Committee. Plans must be submitted, and if not approved or denied within 60 days, the application is deemed disapproved. The committee can also adopt design guidelines.
- Leasing & rentals: Leases must be in writing, for a term of at least 30 days, and cannot be for less than the entire lot. Tenants must comply with all CC&R provisions, but have no voting rights. Owners are responsible for their tenants' violations.
- Vehicles & parking: Private passenger vehicles may be parked only in garages, driveways, or designated areas. No recreational vehicles, boats, trailers, or unlicensed/inoperable vehicles may be kept on the property except inside an enclosed garage or fenced side/back yard. Vehicle repair on the property is limited to enclosed garages. All-terrain vehicles and motorized scooters are prohibited.
- Pets: No commercial breeding or raising of animals is allowed, but a reasonable number of ordinary household pets are permitted, subject to Architectural Committee rules and provided they do not cause annoyance to neighbors.
- Home businesses: No trade or business may be conducted on a lot unless it is not detectable from outside (by sight, sound, or smell), complies with zoning, involves no customer visits or solicitation, and is consistent with the residential character. Leasing a unit is not considered a business.
- Fences & walls: Fences must be block construction (unless otherwise approved), painted to match the structure, and between 6 and 7 feet tall, except front-yard fences closer to the street than the house cannot exceed 3 feet. Wood and chain-link fences are prohibited.
- What this document doesn't cover: The document does not specify HOA fees or assessment amounts, age restrictions, or rules about specific number of pets. It also does not describe amenities or common area facilities beyond their existence. The developer retains significant control until most lots are sold.
