What Silva Mountain's governing documents say
Silva Mountain is a single-family home subdivision in Phoenix, AZ, governed by a standard homeowners' association (HOA) declaration. The HOA enforces rules on architecture, land use, and maintenance, and collects annual and special assessments from all lot owners. This document is the main rulebook for the community.
- Architectural review: All exterior improvements, alterations, and landscaping must be approved in writing by the Architectural Committee before construction. Applications are deemed disapproved if not acted on within 45 days. No buildings may be moved onto lots from elsewhere.
- Use restrictions: Lots are for residential use only. Home businesses are allowed only if they are not visible or audible from outside, involve no more than 20% of floor area, and have no more than one non-resident employee. Door-to-door solicitation and storage of business inventory are prohibited.
- Parking & vehicles: No inoperable vehicles or commercial vehicles may be stored so as to be visible from neighboring property. Motorcycles, ATVs, and similar vehicles may only be parked inside garages. Parking on streets is limited to 24 hours for guests. The Board may tow violating vehicles at the owner's cost.
- Signs: Signs visible from neighboring property are generally prohibited, except for: legal signs, approved residence identification signs, subdivision signs, temporary open house signs (10am-6pm), and for-sale signs (max 120 days per 365-day period).
- Pets: Customary domestic house pets are allowed, but must be leashed when off the owner's property. Owners must promptly clean up pet waste. Animals that create unreasonable noise or nuisance may be prohibited by the Board.
- Maintenance obligations: Lot owners must maintain all landscaping on their lot and adjacent public rights-of-way (unless the Association or city assumes responsibility). Buildings must be kept in good repair and painted. Dead landscaping must be replaced promptly.
- Assessments: The Association levies annual assessments and may levy special assessments. The Maximum Annual Assessment is defined in the declaration but not specified in this excerpt. Assessments are secured by a lien on the lot. Nonpayment remedies include enforcement as provided in the declaration.
- Easements & common area: Owners have a non-exclusive easement to use common areas, subject to Association rules. The Association may dedicate or grant easements over common areas without owner consent during declarant control. Owners must not obstruct drainage or encroach on sidewalks.
