What The Grove at Black Canyon's governing documents say
The Grove at Black Canyon is a commercial office park in Phoenix, AZ. This Amended and Restated Declaration governs the owners of commercial parcels within the development. Residential use is explicitly prohibited. The document establishes permitted uses, an architectural review committee, maintenance obligations, and an assessment system to fund common area maintenance. It is primarily relevant to commercial property owners and tenants, not homebuyers.
- Permitted uses: Parcels may be used for office buildings (including medical/dental clinics and banks), hotels with accessory uses, retail (restaurants, stores, theaters, etc.), child care, and parking garages. Other uses may be allowed only with Committee approval.
- Prohibited uses: Residential, industrial, commercial excavation, dumping, incineration, and drilling for oil/gas/water are strictly prohibited on all properties.
- Architectural & design review: All improvements require prior approval of a five-member Architectural Control Committee. Owners must submit detailed plans (site, exterior, landscaping, lighting, signage) and obtain Final Approval. The Committee has 30 days to act; failure to respond results in presumed approval.
- Owner & association maintenance: Each owner must maintain their parcel and improvements in a clean, safe, first-class condition, including landscaping parking, and signage. The Association maintains common areas (streets, landscaping, security) and may perform owner maintenance at the owner's cost if the owner fails to act after a 10-day notice.
- Assessments & liens: All parcels are subject to a Maintenance Charge based on land area and building area. The Board sets the rate, which may be adjusted annually using the Consumer Price Index. Unpaid charges become a lien on the parcel, subordinate to tax liens and prior mortgages.
- Setbacks & parking: A 20-foot setback from parcel boundaries (except along streets) is required. Parking must meet city zoning requirements; each owner must enforce parking rules for their tenants and visitors.
- Signage: Each approved building is allowed one ground-hugging sign (max 8 ft high) and three facade-mounted signs, subject to Committee approval. Temporary signs for construction or sale are limited to one year. No advertising or flashing signs are permitted without Committee consent.
