Thunderbird Palms is a commercial medical office park in Phoenix, AZ — not a residential community. The CC&Rs govern the owners and occupants of the office buildings, restricting use to medical, dental, and related professional purposes. A Project Manager (initially the Developer) manages common areas and enforces the rules, funded by assessments on each building.
- Permitted uses: Buildings may only be used as medical offices, dental offices, medical/dental labs, physical rehabilitation clinics, surgery centers, radiology clinics, laseography services, or Developer's offices. Any other use requires Declarant's written consent.
- Architectural control: All new construction, exterior alterations, landscaping, and signage must have prior written approval from the Architectural Control Committee. Submit plans with a $100 review fee; the Committee must act within 30 days (or 60 if they give notice). Approved construction must begin within 180 days or approval is revoked.
- Signage: Signs must conform to the Thunderbird Palms Medical Campus Signage Plan (Exhibit C). No flashing, animated, or portable signs. Building-mounted signs are limited to channel letters, with specific size and placement rules. Monument sign spaces are leased separately.
- Maintenance areas & assessments: The Project Manager maintains common areas (landscaping, parking lot, exterior lighting, etc.). Each owner pays a regular assessment based on their building's gross square footage share, plus specific building assessments and expense assessments. Special assessments may be levied for extraordinary costs. A 15% management fee is added to collected monies.
- Parking & vehicles: Uncovered parking areas are shared via a non-exclusive easement. No vans, trucks, or vehicles with business advertising may be parked visible from public streets. Outside storage of materials, supplies, or equipment is prohibited. Covered parking may only be added by the Declarant (up to 26 spaces) and becomes private reserved parking.
- Enforcement & liens: Violations not cured within 10 days of notice allow the Project Manager to enter the building and correct the issue, charging the owner. Unpaid assessments bear interest at the highest legal rate and become a lien on the building, subordinate to mortgages. The document runs with the land for 20 years, automatically renewing for successive 10-year periods.
