Thunderbird Valley (Phoenix, AZ) is a single-family home subdivision governed by a Declaration of Restrictions recorded in 1978. These covenants run with the land and apply to all lot owners. The document sets basic rules about construction, land use, and maintenance, but does not create a homeowners association or impose dues.
- Land use & building type: Lots may be used only for residential purposes. Only one detached single-family dwelling (plus a private garage for up to 2 cars) may be built per lot. No structures of a temporary nature, trailers, tents, or shacks may be used as dwellings.
- Minimum house size: Every single-family dwelling must have a ground floor area of at least 1,000 square feet, excluding open porches, pergolas, and attached garages.
- Setbacks & lot dimensions: Buildings must be set back at least 20 feet from the front property line, 12 feet from side street lines, and 5 feet from interior side lot lines. Minimum lot area is 6,000 square feet. Outbuildings/garages may be on the side lot line if placed more than 75 feet from the front property line.
- Fences, walls & hedges: Front fences/walls must not exceed 3 feet in height and must be set back at least as far as the front wall of the house (or at least 20 feet on vacant lots). Side and rear fences/walls (other than building walls) may be up to 6 feet tall. Hedges over 3 feet are not allowed within 20 feet of the front property line.
- Animals & pets: No animals, livestock, or poultry may be raised, bred, or kept for commercial purposes. Household pets (dogs, cats, etc.) are allowed if kept in a fenced yard or on a leash.
- Nuisance & unsightly objects: No billboards or other unsightly objects may be erected or maintained. No noxious or offensive trade or activity, and nothing that becomes an annoyance or nuisance, is permitted.
- Easements: Easements for utilities and drainage are reserved as shown on the recorded plat. No structures, planting, or materials may interfere with these easements. Lot owners must maintain the easement area on their property, except for improvements maintained by public authorities or utility companies.
- Term & amendments: These covenants run for an initial 30 years from recording (1978), automatically extending for successive 10-year periods unless a majority of lot owners record an instrument to change them.
