Warner Ranch Meadows is a single-family residential community in Tempe, Arizona, part of a larger master-planned development. You own your individual lot and dwelling unit; the association maintains the common areas (landscaping, perimeter walls, drainage easements) funded by annual assessments and special assessments levied on all lot owners.
- What you own & maintain: You own your lot and dwelling unit. The Association maintains all common areas, landscaping in adjacent public rights-of-way, and perimeter walls facing streets. You are responsible for maintaining the exterior of your dwelling and structures on your lot in good condition; if you don't cure maintenance violations within 30 days of notice, the Association may perform the work and place a lien on your property.
- Membership & voting: Every lot owner automatically becomes an Association member with one vote per lot owned. If you lease your lot to a tenant, you may assign voting rights to the lessee in writing. The developer (UDC Homes) initially had enhanced voting power (three votes per lot) that converted to standard membership when Class A votes equaled Class B votes, after seven years from the recording date, or by developer election—whichever came first.
- Assessments & fees: You pay annual assessments (Common Expenses) to cover maintenance, insurance, and reserve funds, computed and levied per lot. Special assessments may be levied for major repairs or reconstruction. All assessments become liens on your property and can be enforced through foreclosure if unpaid.
- Maintenance standards & rules: The exterior of your dwelling must be maintained in good condition and attractive state consistent with Association rules and community standards. The Association Board may adopt and amend rules governing use of common areas without discriminating among owners, provided rules do not conflict with the Declaration.
- Insurance: The Association obtains hazard insurance on common areas at 100% replacement cost, liability insurance (minimum $1,000,000 per occurrence), and fidelity bonds—all as common expenses. You are responsible for obtaining your own liability and hazard/contents insurance on your dwelling and personal property.
- Casualty damage & reconstruction: If major damage occurs to common areas, a special membership meeting is held within 60 days; repairs proceed unless 75% of members in each voting class and 51% of mortgage holders vote otherwise. If insurance proceeds are insufficient for repairs, the Association levies assessments equally across all lots. If your dwelling is damaged, the Board may require you to repair or reconstruct it within a minimum of 8 months at your expense.
- Leasing your lot: You may lease your lot to a tenant. When you do, your rights and easements in common areas are delegated to the lessee for the lease term.
- Master association relationship: This community is subject to a separate Master Declaration (Warner Ranch Phase II). Any annexation of additional property requires master association approval in addition to community approval.
