- What this document covers: This Tract Declaration annexes the La Hacienda Parcel to the SaddleBrooke Ranch Resort Community, designates it as Association Land/Common Area, and restricts its use to a bistro, spa, sports & aquatics complex and related amenities. It gives the Declarant (developer) sole discretion to set rules, pricing, and hours of operation for the facilities.
- Land use restriction: The La Hacienda Parcel may be used only for a bistro, spa, sports & aquatics complex and related facilities and amenities, or other uses approved in writing by Declarant. No other commercial use is permitted without Declarant's approval.
- Control over operations: Declarant has the exclusive right to establish rules and regulations for the parcel, including pricing, hours, availability, staffing, quality, equipment, and maintenance. Declarant may also authorize non-members (e.g., employees, potential homebuyers) to use the facilities.
- Reciprocal use agreements: Declarant may cause facilities on La Hacienda Parcel to be made available to owners in future phases of the community, and vice versa, through reciprocal use agreements or other arrangements.
- Amendments: This Tract Declaration may be amended, modified, or revoked by the Declarant and the owner of the La Hacienda Parcel, but no amendment is effective without Declarant's prior written consent.
