What Serenity Ranches's governing documents say
This document is a shared-well agreement for Serenity Ranches in Saddlebrooke, AZ, not a full homeowners association or condominium rulebook. It binds property owners who receive water from a single shared well, and covers only the rights and obligations related to that water system.
- Shared well & water usage: Water from the shared well may be used only for indoor purposes, animals, and landscaping up to 2,000 square feet. Commercial use is prohibited. A maximum of three owners may share the well. The Board of Trustees may restrict water use in emergencies.
- Fees & assessments: Each owner pays $600 per year in two biannual installments of $300, due February 1 and August 1. Late payments incur a $50 monthly fee. Special assessments may be levied by a two-thirds vote if the reserve fund (capped at $10,000) is insufficient.
- Board of Trustees governance: Each lot owner automatically owns one share of the well and one vote. A Board of Trustees (with a Chief Trustee elected annually) oversees maintenance, fees, and penalties. A quorum is 50% of owners; most decisions require a majority of a quorum, but expansions or amendments need a two-thirds vote.
- Property restrictions: No owner may subdivide or lease any portion of their property. Doing so cancels their well share without compensation, and they must provide an alternate water source for themselves and any tenant.
- What this document doesn't cover: This is only a well agreement. It does not cover architectural rules, pets, parking, leasing terms (other than a blanket prohibition on subdivision/leasing), or any other typical HOA regulations. Those would be in separate documents, if they exist.
