What Sweetwater Ranch Estates's governing documents say
This is an ancillary deed restriction for Lot 54 in the Sweetwater Ranch Estates planned community (Scottsdale, AZ). It binds the current and future owners of that lot only, not all homeowners in the community. The restriction permanently limits use of a specific architectural feature to emergency egress and maintenance.
- Restricted area use: The second-story roof area, its door, wrought iron railing and gate, and the spiral staircase to the ground may be used only for emergency egress and necessary exterior maintenance — no other use is allowed.
- Perpetual and binding: This restriction runs with the lot forever and applies to all future owners, heirs, and assigns. It cannot be amended or terminated without the association's written agreement.
- Enforcement: The Sweetwater Ranch Association may enforce this deed restriction in the same way it enforces violations of the community's Declaration of Covenants, Conditions and Restrictions.
- What this document doesn't cover: This is a single restriction on one lot, not a full set of community rules. It does not cover general CC&Rs, fees, architectural review, pets, leasing, parking, or other typical HOA matters for the neighborhood.
